The Florida Wrongful Death Act Defines Who Can Recover and What

Under the Florida Wrongful Death Act, a personal representative of the deceased's estate brings the claim on behalf of the surviving family. Recoverable damages can include lost support and services, lost companionship and guidance for surviving spouses and children, mental pain and suffering, and the estate's own losses including funeral expenses and lost net accumulations.

The Marin Law Offices represents surviving families across Miami-Dade and Broward with the time, care, and discretion these cases require. Consultations are free, available in English and Spanish, and never involve pressure to sign at the kitchen table.

Representative Workflow

How a Fatal Crash Wrongful Death Case Gets Built

The Problem

A family loses a parent in a fatal collision caused by another driver. The at-fault insurer offers a modest settlement before the personal representative is even appointed and well before the family's full economic loss can be documented.

Our Approach

The firm coordinates the probate appointment of a personal representative, secures the crash investigation file, and works with economic experts to document lost net accumulations, lost support and services, and the loss of companionship and guidance for surviving spouses and children.

The Outcome

Negotiation proceeds from a complete damages picture rather than from a premature settlement offer. Where the at-fault driver's policy is insufficient, the firm identifies UM/UIM and household policies that meaningfully expand recovery.

Wrongful Death Questions

Who can bring a wrongful death claim in Florida? +
The personal representative of the deceased's estate brings the claim on behalf of all surviving family members entitled to recover under the Florida Wrongful Death Act.
Who can recover damages? +
Surviving spouses, minor children, parents of minor children, and in some cases adult children and parents of adult children. Each with their own categories of recoverable damages under the Act. The personal representative brings a single action on behalf of all surviving family members entitled to recover, and the court allocates the recovery among them based on each survivor's losses and relationship to the deceased.
What kinds of damages are available? +
Lost support and services from the date of injury to death and from death into the future, lost companionship and protection for surviving spouses and children, mental pain and suffering for those survivors, and the estate's own losses including funeral and burial expenses, lost earnings between injury and death, and lost net accumulations the deceased would have left behind. Each category is documented with its own evidence. Household-services valuations, economic expert work, and detailed medical and earnings records.
How long do we have to file? +
Most wrongful death claims must be filed within two years from the date of death, with shorter notice requirements for claims against government entities and certain maritime defendants. Acting early is important.
What if the death involved a cruise ship or boat? +
Federal maritime law and the Death on the High Seas Act may apply, with their own deadlines and damages frameworks. We handle these under our Boat Accident practice.
Do we have to go to court? +
Most claims resolve through negotiation. Litigation is sometimes necessary if the responsible parties' insurers will not negotiate fairly, and we prepare every case as if it will go to trial.
